POSITION

The Department of Natural Resources supports the concept of this proposed legislation and believes the intent of Senate Bill 759 can be accomplished without legislative action.

PROBLEM/BACKGROUND

At present, marine fueling techniques, related environmental concerns, and how and where to report a marine fuel spill are not adequately addressed in the boating safety training curriculum.

DESCRIPTION OF BILL

Senate Bill 759 would amend Part 801, “Marine Safety,” of 1994 PA 451 to require the boating safety training course to include information on proper marine fueling techniques, problems associated with marine fuel spills, and how and where to report marine fuel spills.

SUMMARY OF ARGUMENTS

Pro

Marine fueling techniques, related environmental concerns, and how and where to report a marine fuel spill are important topics that need to be appropriately addressed in the boating safety training curriculum.

Con

Legislation is not needed to accomplish the intent of Senate Bill 759.  The Department supports these proposed additions to the boating safety training curriculum and will do so with the next printing of curriculum booklets during the 2004 calendar year.

Budgetary:

None – provided the curriculum changes are made within the normal printing cycle for classroom materials and instructors are updated on this curriculum change in schedule with normal instructor training cycles.

Comments:

The Department is proposing to make the changes recommended by this legislation during the 2004 calendar year without incurring additional program costs by incorporating the changes within normal printing and instructor training cycles.
